(Last Will and Testament of John Ballard, Wayne/Dobbs CO, NC March 12, 1763)

In the name of God Amen, I John Ballard of the province of North Carolina in Dobbs
County being in good health of body and of sound mind and memory praise be given to
almighty god do make and order this my last Will Testament in manner and form
following that is to say first and particularly (?) I commit my sole into the hands
of almighty god hoping through the merits of death and patron of my Lord and savior,
Jesus Christ to have full and free pardon and forgiveness of all my sins and my body
I commit to the earth to be decently buried at the discretion of Executors herefore
named and what worldly goods and Estate it hath pleased almighty god bestowed upon me
I give as, dispose as follows. First I will that all debts and funeral charges be
paid and discharge.

Item- I lend my beloved wife the use of my whole estate during her widowhood.

Item- I give to my daughter Ann one shilling sterling.

Item- I give to my daughter Ruth one shilling sterling.

Item- I give my son John one shilling sterling.

Item- I give my daughter Rachel one shilling sterling.

Item- I give Joseph Ballard Boite (Boyte?) ten pounds sterling to have good schooling
given by the executors.

Item- I give Jacob Ballard Boite (Boyte?) ten pounds sterling to have good schooling
given by the executors.

Item- I leave my son Elisha in the hands of my son Elias to be well taken care of as long
as he lives.

Item- I give my son Elias my whole and sole Estate to him and his heirs forever and lastly

I do hereby constitute and appoint Elias Ballard and Theoplus Jones my whole and sole
Executors of this my last Will and Testament and I do hereby revoke, disenull and make
void all former Wills and Testaments heretofore by me made. In witness where of I have
here unto set my hand and seal this 12th day of March in the year of our Lord one
thousand seven hundred sixty three.

To Elias Ballard Greeting
For certain causes offered before our County Court of Pleas and quarter sessions, for the County of Wayne, we Command you that you personally appear before the Justices of our said Court at the next Court to be held for the County of Wayne at the Court House on West Point on the Second Monday in July next, then and there to answer such things as shall be objected to you, and do further and receive what our said Court Shall have considered in this behalf, and this you may in no wise Omitt (sic) under the penalty of one hundred pounds specie, witness James COBB Clerk of our said Court at office this Tenth day of April anno Dom 1786 in the Tenth year of our independence

“To the worshipfull Court of Wayne County The Petition of Joseph Ballard BOYET and Jacob Ballard BOYET. Humbly sheweth That on or abought the 12th day of March 1763 John BALLARD Father to your petitioners departed this life, having first made his last will and Testament appointing Elias BALLARD Executor thereto, who qualified and took upon himself the execution of the same – your Petitioners further shew this worshipfull Court that by the said last will and Testament the sum of Ten pounds Sterling money was devised to each of your Petitioners, for the express purpose of Schooling and educating your petitioners by the Executor, But now so it is may it please your worship, the said Elias. Executor as aforesaid altogether regardless of his Trust as aforesaid never did layout the same Ten pounds Sterling on the education of each, or either of your Petitioners, but hath retained the said Several Sums of Ten pounds Sterling to himself, wherefore your Petitioners conceive themselves injured and Humbly pray that this worshipfull Court will decree and adjudge the Said the said (sic) Elias BALLARD Executor as aforesaid, do pay unto your petitioners Each of them, the sum of Ten pounds Sterling money with Lawfull Interest thereon from September 1763 equal to Twenty seven Pounds Twelve Shillings specie, with Costs, and your petitioners as in duty bound shall ever etc. [signed] Joseph Ballard BOYET, Jacob Ballard BOYET by Thos. It has been satisfactorily proven to the court at its Session on the 5th day of November 1844 that Jacob B. BOYT a Revolutionary Pensioner of the United States - late of this County, died on the 5th day of August 1844 - and that he left a Widow, to wit: Lydia BOYT whose signature appears to the annexed power of Attorney

I further certify that Colin Munroe (sic) before whom the power of Attorney is executed, and the acknowledgement made Is an acting Justice of the Peace in & for said County, and that the signature purporting to be his, is genuine

WAR DEPARTMENT REVOLUTIONARY WAR CLAIM

I certify that in conformity with the Law of the United States, of the 7th June, 1832, JACOB B. BOYT of the State of North Carolina who was a Private in the Revolutionary Army is entitled to receive - Twenty Six - dollars and Sixty Six cents per annum, during his natural life, commencing on the 4th of March, 1831, and payable semi-annually, on the 4th of March, and 4th of September, in every year.

Given at the War Office of the United States, this 1st day of March one thousand eight hundred and thirty three.

Payments to be made at Fayetteville by Presd’t U.S. P___ Bank. Agent for paying Pensioners in the Agency of North Carolina Recorded by ----Stites Clerk in Book D Vol --_ Page 49.

BOYT deceased late of the County of Bladen a pensioner of the United States, do by these presents appoint James Huske my true and lawful attorney for me and in my name to ask for and receive from the agent of the United States in Fayetteville, North Carolina, the amount due me, as the Widow of the said Jacob B.BOYT, from the 4th March 1844 to the day of his death

Jacob served in the Revolutionary War as a private, first in the Dobbs County Militia. Then he
enlisted for five months with Jethro Sunmer. Tthe area that was Dobbs County, became
Wayne County, NC. He was assigned to Col. William Caswell. The troops marched from
Kinston to Elizabethtown, Bladen County, NC, then to the Ten Mile House on the road to
Charleston, SC. From there they continued on to Corchester and then augusta, GA. Jacob's
outfit fought in the Battle of Briar Creek, but Jacob was not in the action as he had been left
with the baggage on the opposite side of the river. Shortly after this battle, his term of service
expired, and he received a discharge and returned home. In October 1779 Jacob was drafted
into service again and served until April1780.

I noticed you have a Harry Chatten Boyte b. ???? under William Franklin Boyte Sr. b. 1869. My ancestor is Chatham Boyett or as he is listed in 1849 Arkansas Land Records Chatten Boyt. This is the first time I have ran across Chatten in any connection with the Boyette/Boyt name. My DNA project kit number is 25431 . I am still trying to find Chatham/Chatten Boyett's parents and close relatives. From DNA projec it is know he is a from Thomas Boyt line .
