Got this e-mail today:
Hi Doug,

We have received a notice of copyright violation in one of your
galleries at http://www.pbase.com/dougkess/lacma_jan_06 , specifically
the following images:

http://www.pbase.com/dougkess/image/54928549
http://www.pbase.com/dougkess/image/54929742
http://www.pbase.com/dougkess/image/54929921

I am attaching scans of the notice we got so you can take appropriate
action.

Thanks,
Emily S. Neel

Apparently, a few of the paintings I was showing in my gallery
are copyrighted and the controllers of the estate wanted
15 Euros per month per painting for me to leave them on my web page.
They may even try to charge me for the time they were up (8 months).
They are from Germany so I may have Guenter handle this : )

That gallery is one of my more popular ones and I would be reluctant to take it off.
I have removed the pictures in question.

The depth of search engines has increased notices such as these.
Even building are copyrighted. I was told to stop taking photos of a courtyard because its design is copyrighted.

Ouch. Hang in there, Doug...

Hey - I have a copyright on the letter X. Please send royalties right away
Guest 26-Sep-2006 15:44
Holy cow. Now I have to agree that it's ridiculous. Maybe removing the photographs from the gallery will be the end of it. Geeezzzz.

It wasnt like you were saying you make the paintings were you? So i dont see why that would be the problem...I mean If you were saying that the paintings were yours that would be one thing but to turn someone elses art into something differnt and make it yours I think that is a little different... That would be like taking a pic of the london bridge or Milliniem park and getting into copyright laws....

Bummer. I remember a few years ago when Mr. Gates was attempting to corner the market on ALL digital representations of classic art. I guess that is why they also post the "no photographs allowed" in most musuems. Still, if you are not using them commercially I'm not sure they have a leg to stand on. Thanks to Guenter for the help. Please let us know what y'all find.

Kind of rediculous. One should assume that having the images in your gallery would rather be a good PR for them rather than a violation of copyrights (so its rather you who should charge money from them)... Good luck!
Guest 26-Sep-2006 09:06
Good luck, Doug!
Barbara Heide26-Sep-2006 06:27
you should charge them, as you are making their pictures more popular!
Good luck to you!

I`m afraid, this happens one day to me too! There`s no commercial use showing the paintings here in pbase...! :(

Doug, would you mind to send me a copy of that notice? So I`m able to contact them!

That's amazing.. just goes to show how popular pbase is.

I would assume that as long as you've removed the ones in question,
you should be ok.
I suppose that's the reason we have copyright laws anyway.
Yes, let Guenter handle this.
: )

:-(
I understand you... It's sad, but what can we do?
Jen Bixler26-Sep-2006 02:08
Sad ;o(
I know nothing about Euros...what is that in US Dollars?
Maybe, we could start a collection fund...good luck.
