Contrary to what many believe, higher ISO's on the 40D in even the poorest lighting are quite usable. You do not have to upgrade to a 7D to gain that usability. If shooting in very low light is such a need, go full frame.
Keep in mind, this is a very low mixed light setting as can been seen by the shutter speeds achieved. A basketball game would have roughly 4-6x more lighting with these same settings.
